WAUPACA COUNTY, WI (WTAQ-WLUK) – A wrongful death lawsuit filed the family of Tanna Togstad will be allowed to continue, after a judge rejected Tony Haase’s attempt to have it dismissed.
Haase was acquitted in August for the 1992 murders of Togstad and Mumbrue at a home in rural Waupaca County. Shortly before the trial was concluded, Togstad’s family filed a civil lawsuit, seeking $17 million in damages.
In pre-trial motions, Haase argued that those who filed the lawsuit were ineligible to do so by state law.
But in a three-page decision issued Monday, Judge Vince Biskupic allows the Togstad’s surviving siblings to be named as replacement plaintiffs.
The judge also allowed claims negligence and recklessness to be added to the lawsuit.
Moreover, it is still relatively early in the history of this case. Discovery is still ongoing, and no trial dates have been set. Haase and Maple Valley are not prejudiced by Togstad’s amendments. Haase arguably benefits from new claims that make insurance coverage for his defense more likely. Thus, the Court finds leave should be granted to Togstad to amend the Complaint,” the ruling states.
No trial date has been set. Another hearing is set for Monday on other pre-trial motions.
As he did at the criminal trial, Haase has denied the civil case allegations he killed the couple.
