(WTAQ-WLUK) — Eight of the state’s Native American tribes have asked a court to dismiss a lawsuit challenging their ability to offer online sports betting.
The Brown County Taxpayers Association filed suit in Waukesha County, arguing Act 247 violated the state Constitution and its 1993 amendment authorizing certain forms of gambling. The suit argued the act singles out members of the tribes for a benefit not available to others based on race.
Previously, the Wisconsin Attorney General’s office filed a response defending the law.
In a 36-page filing this week, the eight tribes — including the Oneida Nation and Menominee Indian Tribe of Wisconsin — asked the court to dismiss the suit.
A Nov. 9 hearing is scheduled in the case.
