GREEN BAY, WI (WTAQ-WLUK) — Miron Construction is stopping its effort to prevent the awarding of a bid for construction at a Green Bay park to a competitor.
Since the city of Green Bay has responded in court filings to Miron’s lawsuit, Miron said Tuesday it would not pursue the dispute any further.
Last month, the city awarded a bid for construction at Leicht Memorial Park to Hatley-based 8Pine. Fox Crossing-based Miron sued and won a temporary restraining order, alleging 8Pine did not follow all the city’s requirements for the bid.
In a response filed earlier this month, the city said it “lawfully exercised its right to waive informalities or non-material irregularities in bids.”
In a news release, Miron said it filed the lawsuit only after trying to contact the city but receiving no response.
The release continued:
If the City had responded to Miron’s multiple inquiries, this matter could have been resolved without Court intervention. Now that the City has acknowledged Miron’s concerns, Miron has elected not to pursue this dispute any further and will defer to the City’s decision to waive the bid discrepancies Miron identified.
Online court records indicate a hearing in the case remains scheduled for Friday.
