GREEN BAY, WI (WTAQ-WLUK) – The winning bidder for improvements at Leicht Memorial Park denies it failed to meet the project’s requirements, and asks for a lawsuit filed by Miron Construction to be dismissed.
After Miron Construction didn’t win the bid to build a new pavilion and other site improvements in the park on the west bank of the Fox River, Miron filed suit.
The City of Green Bay hasn’t formally replied yet, but 8Pine Construction – the winning bidder – has, according to a court document.
8Pine denied the main allegation by Miron: “In Response to Paragraph 2 of the Verified Complaint, this answering Defendant hereby states that no answer is required, but to the extent an answer is required denies that 8Pine’s bid was unresponsive, denies that 8Pine’s bid had irregularities, denies that Miron was the lowest responsible bidder,” the response states.
8Pine also “denies 8Pine submitted an unresponsive and inaccurate bid,” it states.
8Pine asks for the case to be dismissed.
A Jan. 23 motions hearing is scheduled.
