GREEN BAY, WI (WTAQ-WLUK) — Two brothers were convicted Monday in connection with a murder stemming from a February 2023 bar fight.
Omar Hernandez, 25, and Jose Hernandez, 24, will be sentenced Sept. 4, according to a court official.
The plea deals avoid a trial, which had been scheduled for jury selection on Aug. 16.
Both had been charged with being party to first-degree intentional homicide, and other counts. However, court records show the most serious count against Omar Hernandez was changed to first-degree reckless homicide, and the most serious against Jose Hernandez was changed to attempted homicide.
According to the criminal complaints, police responded to Clayton Place, near Eisenhower Park, for report of shots fired on Feb. 11, 2023. One man, lying in a front yard, was dead with “massive trauma to his head,” while another was taken to the hospital with three gunshot wounds to the chest.
The incident was the continuation of a fight which happened at a bar a few hours earlier.
Omar Hernandez told police “don’t do nothing to my brother. He didn’t do anything. It was me. I did it,” the complaint states. “Omar stated he shot the gun three or four times, only shooting at the two males. Omar stated he knew that he had hit them when he shot.”
“Jose admitted to holding the handgun during the disturbance but denied shooting,” the complaint states. Witnesses describe Jose as firing the gun, however.
