WISCONSIN (WTAQ-WLUK) – For the second time, a court has rejected the appeal of a former high school teacher convicted of sexually assaulting teenagers.
Jason LaVigne is serving a five-year prison sentence for the June 2018 incident in Marinette County. He also was convicted in Outagamie County for sexually assaulting a student at Little Chute High School in 1999.
This appeal pertains to the Marinette County case, where LaVigne was convicted of sexually assaulting a 16-year-old girl after providing her with alcohol. LaVigne argued his trial counsel erred by asking to send the jury an unredacted DNA report containing passages that the circuit court previously had excluded from evidence. At a post-trial hearing, the attorney said it could have been helpful to the defense to have the jury think some unknown male’s DNA had been found the victim.
In a seven-page ruling issued Thursday, the appeals court rejected LaVigne’s arguments.
