APPLETON, WI (WTAQ-WLUK) — Tyrese Simmons was sentenced Monday to three years in prison for firing shots in Appleton’s Erb Park. No one was injured in the June 25, 2024, incident.
Simmons, 21, was also placed on extended supervision for three years by Judge Emily Lonergan.
Simmons, who was convicted of second-degree recklessly endangering safety and being a felon in possession of a firearm, apologized before the sentence was issued.
“I just lost my way when I was out there, and I didn’t know who I really was until I got incarcerated. Now, I got my family, they are looking out for me; they’re telling me I’m going to do great things. And I know I’m going to do great things. And I just want to show my mom, my family, that I don’t want to live this live any more. I just want to say I’m truly sorry to the people I scared,” Simmons said.
According to the criminal complaint, Simmons approached a bunch of juveniles, asking about a phone which had been lost or stolen on June 25, 2024. Simmons then pulled a gun out of backpack and fired. Witnesses reported hearing three or four shots.
Police found two spent 9mm casings and one unspent round near the park pavilion. Simmons was tracked down and arrested. Police found a gun in his backpack.
Simmons is currently housed at the Racine Youthful Offender Correctional Facility for unrelated cases.
